Welcome to Cleft and Sounds (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern the use of our website https://cleftandsounds.co.ke/, booking of our services, and attendance at our live performances. By booking our services, attending an event, or using our Website, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use our Website or book our services.


1. About Us

Cleft and Sounds is a live music band offering customized music entertainment for social and corporate events. We provide instrumental and vocal performances tailored to meet client needs.


2. Services

  • Live music performances for private, social, and corporate events.

  • Customizable music packages based on client requirements.

  • Optional add-ons (e.g., sound system, additional instrumentalists, MC services) as agreed in writing.


3. Booking Policy

a) Making a Booking

  • Bookings can be made via our Website, email, or direct contact.

  • A booking is considered confirmed only after:

    • Completion of a booking form (where applicable), and

    • Payment of the required deposit or full performance fee.

  • Verbal agreements or informal messages do not constitute confirmed bookings.

b) Deposits and Payments

  • A non-refundable deposit of [insert % or fixed amount] is required to secure the booking.

  • The balance of payment must be settled no later than 5 days before the event date.

  • Failure to complete payment within this timeframe may result in cancellation of services.


4. Cancellation & Refund Policy

a) Client Cancellations

  • Cancellations made more than 5 days before the event date: Eligible for a partial refund (deposit is non-refundable, but any balance paid will be refunded).

  • Cancellations made within 5 days of the event: No refunds will be issued.

  • No-shows (where the client cancels or fails to proceed with the event without notice): 100% of the agreed fee will be charged.

b) Band Cancellations

  • In the rare event that we must cancel due to unforeseen circumstances (e.g., illness, emergency, force majeure):

    • We will notify the client immediately.

    • Any payments made will be fully refunded.

    • Alternatively, we may work with the client to arrange a substitute performance (subject to client approval).


5. Event Requirements

  • The client must ensure a suitable performance space, including power supply, stage (if applicable), and weather cover for outdoor events.

  • If sound equipment is not provided by the client, arrangements must be made with us at the time of booking.

  • The client agrees to provide safe and secure conditions for performers and equipment.


6. Changes to Bookings

  • Any requested changes (e.g., event time, venue, music selection) must be communicated in writing at least 7 days before the event.

  • Changes requested within 7 days will be subject to availability and may incur additional charges.


7. Client Responsibilities

  • The client is responsible for obtaining all necessary permits, licenses, or venue approvals for live performances.

  • The client must ensure that any venue restrictions (e.g., noise limits, curfews) are communicated to us in advance.

  • The client agrees not to record, livestream, or broadcast our performance without prior written consent.


8. Liability

  • We are not responsible for delays or cancellations caused by circumstances beyond our control (e.g., extreme weather, power outages, venue restrictions, force majeure).

  • We are not liable for indirect or consequential losses (e.g., loss of profit, business disruption) arising from performance cancellations.

  • Our liability is limited to the total fees paid for the event in question.


9. Intellectual Property

  • All performance content, including musical arrangements and promotional materials, remain the intellectual property of Cleft and Sounds.

  • Clients may not use our name, logo, or promotional content without written permission.


10. Photography & Media

  • We may capture photos or videos at events for promotional use only with client consent.

  • Clients who do not wish for their event to be recorded or publicized must notify us in writing before the event.


11. Privacy

Your personal data will be collected and processed in accordance with our Privacy Policy.


12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes will be subject to the exclusive jurisdiction of the Kenyan courts.


13. Updates to Terms

We reserve the right to update these Terms at any time. Updates will be posted on our Website, and continued use of our services constitutes acceptance of the revised Terms.
